Ask The Expert: We Filed Chapter 7 Bankruptcy. How Long Do We Have to Wait Before We Can Get a Mortgage?

Published

on

Probably a good deal less time than you think.

Many people think 10 years because a Chapter 7 bankruptcy can stay on a credit report that long.

But that’s a different clock from the one mortgage programs use to determine when a borrower may become eligible for a new home loan.

Depending on the mortgage type, the waiting period can be as little as two years after a Chapter 7 discharge, with some exceptions that can shorten it further.

The important word is discharge.

In general, the waiting period starts on the bankruptcy discharge date, not the date you first filed the case.

That distinction can matter by several months.

FHA: Generally Two Years

For an FHA-insured mortgage, HUD’s underwriting guidelines generally call for at least two years to have passed since the Chapter 7 bankruptcy was discharged.

The borrower must also have reestablished good credit or chosen not to incur new credit obligations.

FHA loans can be particularly attractive to buyers rebuilding after financial trouble because they require as little as a 3.5% down payment for borrowers who otherwise qualify.

However, reaching the two-year mark doesn’t automatically mean the loan will be approved.

It means the bankruptcy itself may no longer prevent the borrower from being considered under the normal FHA guidelines.

VA: Two Years Is A Common Benchmark

VA-backed mortgages also commonly use a two-year period following a Chapter 7 discharge.

For eligible veterans, active-duty service members, and certain surviving spouses, a VA loan has another significant advantage: qualified borrowers may be able to purchase a home with no down payment.

VA guidelines may also allow earlier consideration when the bankruptcy resulted from circumstances beyond the borrower’s control and the borrower has since demonstrated satisfactory credit.

In some qualifying cases, consideration may be possible after one year.

Military eligibility by itself doesn’t guarantee mortgage approval. Income, credit history, debts, and other VA loan program requirements still apply.

USDA: Watch The Three-Year Mark

USDA home loans use a different benchmark.

A Chapter 7 bankruptcy discharged within the past 36 months can be treated as adverse credit when underwriting the application.

USDA loans are intended for eligible borrowers purchasing homes in qualifying rural areas and can offer 100% financing.

As with the other programs, exceptions or additional underwriting considerations may apply depending on the circumstances and the borrower’s overall credit history.

Conventional: Generally Four Years

A conventional mortgage backed by Fannie Mae or Freddie Mac generally has the longest standard waiting period among these common options.

The usual waiting period after a Chapter 7 bankruptcy is four years.

That doesn’t mean someone two or three years past bankruptcy has to wait for a conventional loan before buying a house.

It means conventional financing may not yet be available under the standard bankruptcy waiting-period rules, while an FHA or VA mortgage might be.

That is why the type of mortgage matters so much.

Someone who simply hears, “You had a bankruptcy,” and assumes homeownership is off the table for a decade could wait years longer than necessary.

Exceptions Can Matter

Exceptions can also apply when a bankruptcy resulted from documented circumstances outside the borrower’s control.

A serious illness, involuntary job loss, or death of a household wage earner may be examples, depending on the loan program and the facts of the case.

The key words are documented and outside your control.

Simply explaining that money was tight generally isn’t enough. A lender will want evidence supporting the circumstances and will also look closely at what happened financially after the bankruptcy.

Don’t treat the exception as an automatic shortcut.

It is a path for borrowers whose bankruptcy resulted from unusual circumstances rather than an ongoing pattern of financial problems.

Use The Waiting Period To Rebuild

There is another important distinction.

Becoming eligible to apply isn’t the same as qualifying for the mortgage.

A borrower can reach the required date and still be turned down because of credit, income, debt, or another underwriting issue.

That makes the waiting period valuable.

Pay every bill on time.

Keep credit card balances under control.

Avoid taking on unnecessary debt.

Build some savings.

Check your credit reports for errors.

And keep records showing stable employment and income.

A lender looking at someone who went through bankruptcy two or four years ago isn’t only interested in what happened then.

The lender wants to know what has happened since.

Two years of careful credit management can tell a very different story from two years of missed payments and new debt.

Savings matter, too, even when considering a loan program with a low or no down payment. Homeownership comes with closing expenses, moving costs, and inevitable repairs that seem to appear shortly after someone gets the keys.

One Lender’s Answer Isn’t Necessarily The Last Word

Mortgage program guidelines establish minimum standards, but individual lenders can have additional requirements.

That means one lender may say no even though a borrower has passed the basic waiting period for the loan program.

Another lender may evaluate the same situation differently while still following the program’s rules.

So don’t assume one rejection means every mortgage lender will give the same answer.

And don’t wait until you’ve found the perfect house to discover which rules apply to you.

Talk with a knowledgeable mortgage professional beforehand and explain the bankruptcy from the beginning. Ask which loan programs may be available, when you become eligible, and what you should work on before applying.

Most importantly, pull out your bankruptcy paperwork.

Find the discharge date.

Don’t rely on your memory of when you filed.

You may discover the mortgage clock started earlier than you thought—and that the 10-year wait you had in mind was never the mortgage waiting period in the first place.
