Supervisors Deny Pared Back Little Boy Ventures Permitting and Text Amendment Requests

(Update: The vote on item C-2, the Milldale Farm request for removal from the Rockland Ag-Forestal District, has been corrected to a unanimous vote of approval.)

As previously reported in Royal Examiner’s lead story on the April 29th Special Meeting of the Warren County Board of Supervisors that meeting featured nine public hearings.

Among those public hearings were two regarding Little Boy Ventures LLC’s pared back requests for, not only Conditional Use Permitting (CUP) for Private Use Camping for occupants of “up to four recreational vehicles”, but also a County Code text amendment: “to add training facility and social hall as uses permitted by Conditional Use Permit in the Agricultural zoning district” and “to enact §180-56.6 to add supplementary regulations for social hall, and to amend §180-57 to add supplementary regulations for training facility.”

Warren County School Board member Melanie Salins appeared at a Little Boys Ventures Public Hearing in her role as a county citizen. Public hearing comments on those two items reflected the evolving concerns of the supervisors on county-wide impacts of even the pared back Little Boy Ventures proposal. Consequently, both the Private Use Camping CUP and the requested text amendment were denied. The text amendment was denied by a unanimous vote on a motion by Supervisor Cook, second by Supervisor Jamieson. After some discussion on the numbers implied by the “up to four recreational vehicles” wording, on a motion by Cook, second by Supervisor Stanmeyer, the Private Use Camping CUP was denied by a 4-1 vote, Cullers dissenting.

Cullers explained her dissent in worrying that denial could set a reverse precedent making Private Use Camping permitting too difficult to achieve in even appropriately zoned areas of the county. Cullers initial motion to approve the Private Use Camping CUP request died without a second.

If not during New Business items regarding the future of public library operations in Warren County, during public hearings the board was largely in agreement on the items before them. Only supervisors Cullers and Cook cast lone dissenting votes on several items.

The staff summary and votes on the other seven public hearings are listed in the order presented below:

6:30 PM – Public Hearings

C1. Public Hearing Ordinance to Amend and Re-Ordain Section 179-19 of the Warren County Code (Connection and Consumption Rates and Fees in the Shenandoah Shores Sanitary District)  – Mike Berry, Public Works Director

As indicated in the lead two staff “Explanation and Summary” paragraphs below, that staff summary at least in part seemed to indicate a correction to some mistyped fee numbers previously submitted with the ordinance request.

EXPLANATION & SUMMARY:

“Basic connection fee. The basic connection fee covers installation of the water meter and partial payment for backup facilities. Payment for connection shall accompany the application for connection as follows: $3,5004,000 & $1,5002,000.

“1. The basic connection fee for a new single-family dwelling served by the central water supply system of the SSCWA shall be $ 3,500  4,000, plus the payment of a one-time membership fee in Shenandoah Shores Cooperative Water Association of $ 1,500  2,000.

“2. The basic connection fee for an existing single-family dwelling served as of the effective date of this article by an individual private well shall be $1,750. Consumption and use charges.  All users and consumers of SSCWA water shall be billed quarterly the following charges:

“1. For all consumption and use up to 16,000 gallons per quarter as metered at the individual connection: $120.12.

“2. For all consumption use of at least 16,001 gallons but not exceeding 26,000 gallons per quarter as metered at the individual connection there shall be a surcharge of $0.0091 per gallon so consumed and used.

“3. For all consumption and use above 26,001 gallons per quarter as metered at the individual connection there shall be a surcharge of $0.010.”

On a motion by Stanmeyer, second by Jamieson, the rates were unanimously (5-0) approved as presented.

C2. Public Hearing – Request for Withdrawal from Rockland Ag-Forestal District – Milldale Farm, LLC – A request for withdrawal from the Rockland Agricultural – Forestal District. The properties are located at 959 Milldale Farm Rd. and are identified on tax map 7, as lots 1A and 2. The properties are zoned Agricultural (A) and are located in the Milldale Farm – John W. Warner + Catherine Conover land in the Shenandoah Magisterial District. – Matt Wendling, Planning Director

On a motion by Stanmeyer, second by Jamieson, the withdrawal request was approved by a unanimous vote.

C3. Public Hearing CUP2025-03-02 – Short-Term Tourist Rental – Garrett McNamara – A request for a conditional use permit for a short-term tourist rental. The property is located at 16 Trillium Trail Road and is identified on tax map 24B, section 2, block 6, as lot 269. The property is zoned Residential-One (R-1) and is located in the Blue Mountain subdivision in the Shenandoah Magisterial District. – Kelly Wahl , Planner

On a motion by Jamieson, second by Cook, the CUP request was unanimously approved.

C4. Public Hearing CUP2025-03-05 – Short-Term Tourist Rental – Vesta Properties (Theophilos Perperidis) – A request for a conditional use permit for a short-term tourist rental. The property is located at 101 Crowfoot Ct and is identified on tax map 26A, block 7A, as lot 35. The property is zoned Residential-One (R-1) and is located in the Thunderbird Ranch subdivision in the Fork Magisterial District. – Kelly Wahl , Planner

On a motion by Cook, second by Stanmeyer, CUP request was unanimously approved.

C5. Public Hearing CUP2025-03-01 – Short-Term Tourist Rental – Christopher Phair – A request for a conditional use permit for a short-term tourist rental. The property is located at 295 Donna Court and is identified on tax map 15D, section 2, block 5, as lot 278. The property is zoned Residential One (R-1) and is located in the Shenandoah Farms – River View subdivision in the Shenandoah Magisterial District. – Chase Lenz, Zoning Administrator

On a motion by Jamieson, second by Stanmeyer, the CUP request was approved by a 4-1 vote, Cook dissenting.

C6. Public Hearing CUP2025-03-06 – Short-Term Tourist Rental – Rufino Maltez – A request for a conditional use permit for a short-term tourist rental. The property is located at 283 Sunset Village Road and is identified on tax map 27D, section 3, as lot J1. The property is zoned Residential-One (R-1) and is located in the Junewood Estates subdivision in the Fork Magisterial District. – Chase Lenz, Zoning Administrator

On a motion by Jamieson, second by Cook, the CUP was unanimously approved.

C7. Public Hearing SV2025-03-01 – Subdivision Variance – Michael and Tina Litwin – A request for a variance from Warren County Code §155-3.B(1)(b)[2] of the Subdivision Ordinance to allow the voluntary transfer of a proposed family subdivision lot to an immediate family member within the required five (5) years of having held fee simple title to the property. The property is located at (0) Bordentown Lane and identified on tax map 35, as lot 33. The property is zoned Agricultural (A) and located in the John F. Payne Properties subdivision adjacent to the railroad in the South River Magisterial District. – Matt Wendling, Planning Director

On a motion by Cullers, second by Jamieson, the variance request was approved by a 4-1 vote, Cook dissenting.

And that completed the Public Hearing agenda for the evening.
