Next Hearing in Supervisor Tony Carter’s DUI Case Set for Dec. 8

A check of Warren County General District Court case records indicates December 8th as the date set for the next step in the Class One, Misdemeanor charge of DUI (Driving Under the Influence) first offense case against Happy Creek District Supervisor Tony Carter. Carter, also now the vice-chairman of the County Board of Supervisors with which he has a 20-plus-year history, was represented by defense counsel David Hensley in a Process/Motions Hearing on September 15. Carter was not required to be present for the hearing and was not.

However, he is likely to be present at the next hearing on December 8, as two options, among others, on the table for that session are likely to be setting a trial date or accepting a plea agreement reached by the defense and Special Prosecutor Bryan Layton. Layton was appointed to the case due to the defendant’s position as long-time public figure and elected official here.

The September 15th continuation to the December 8th date was mutually agreed upon by both prosecution and defense counsel.

Court filings in the DUI case against Carter indicate he was arrested by Warren County Sheriff’s Office Deputy D.J. Neely at 6:10 p.m. on January 17, 2026, after registering a blood alcohol content of .182 at the scene. Asked if and when he had been drinking alcohol prior, Carter indicated about two hours and cited three drinks as his alcohol consumption total.

But with the above .08 legal limit exceeded and the officer citing Carter failing two of three field sobriety tests, walk-and-turn and one-legged stand, Carter was processed for arrest on the Class One Misdemeanor charge of DUI, first offense. Court records also indicate that the arresting officer responded to a report of a vehicle fire and encountered Carter alone at his overheated, parked vehicle in the area of the fire report.
