Imprisoned Former EDA Executive Director Jennifer McDonald Could See Slight Reduction of 14-Year Sentence on Appeals Court Ruling

Prosecutorial and Public Relations personnel of the Harrisonburg Federal Court system have verified an Appeals Court order for the resentencing of former Front Royal/Warren County Economic Development Authority Executive Director Jennifer McDonald. After a lengthy and often delayed, primarly over health issues, trial that began on August 21, 2023 and ended on Halloween Day (Oct. 31) of that year, McDonald was initially convicted by a jury on 34 counts of Bank and Wire Fraud, Money Laundering, and Aggravated Identity Theft. However, convictions on four fraud charges were later dismissed on appeal by Federal Court Judge Elizabeth Dillon.

McDonald was sentenced to 14 years on the remaining 30 counts by Judge Dillon. McDonald was also ordered to pay a large amount, several million dollars in restitution. But now an Appeals Court ruling has ordered a resentencing of McDonald in the wake of the overturning of the Aggravated Identity Theft conviction. How that might impact McDonald’s initial 14-year sentence remains to be seen. But if, as it appears to be, a lone count of the remaining 30 convictions, one might anticipate the sentencing change not to be overwhelming in its reduction.

The Aggravated Identity Theft charge involved ITFederal principal Truc “Curt” Tran and his proposed economic redevelopment project at the former Avtex facility and federal Superfund site. Tran testified at McDonald’s trial that he did not sign a document with his name written on it, which was alleged to have been presented by McDonald to enable a loan she accessed illegally, the prosecution argued at trial.

After her medical diagnosis, McDonald received a heart pacemaker during her trial, upon conviction she was ordered to serve her sentence at the nearest federal prison with a full scale medical facility. Unfortunately for McDonald and family or friends anticipating visitation in a closer facility in Virginia or West Virginia, the Federal Medical Center deemed the nearest such federal medical facility to Warren County, Virginia, is in Carswell, Texas.

McDonald, 46 upon her 2023 conviction, is currently slated for release in September of 2035, when she would be 58 years old.
