Rushmark Properties Withdraws Data Center Zoning Text Amendment and Conditional Use Permit Applications

Warren County has received formal notification from Rushmark Properties requesting the withdrawal of its pending Zoning Text Amendment and Conditional Use Permit applications associated with a proposed data center project on Rockland Road.

In a letter dated August 11, 2026, Rushmark Properties requested the withdrawal of the following applications for the property located at 0 Rockland Road, identified as Tax Map 12A, section 1, block 16, lots A2 and A3:

  • Z2026-05-01 — Zoning Text Amendment for Data Centers in the Industrial (I) Zoning District
  • CUP2026-05-01 — Conditional Use Permit for a Data Center

The withdrawal request was submitted to the Warren County Department of Planning by Rushmark Properties President Dan Doty. In its correspondence, Rushmark expressed appreciation for the time and resources the Warren County Board of Supervisors, Planning Commission, and Planning staff dedicated to evaluating the applications.

As a result of the applicant’s withdrawal of both applications, the public hearing previously advertised for the Warren County Board of Supervisors meeting on Tuesday, August 18, 2026, regarding the Zoning Text Amendment has been canceled. No action will be taken by the Board of Supervisors on the withdrawn applications.

Warren County recognizes the significant public interest surrounding these applications and appreciates the participation of residents throughout the review process. The County remains committed to providing opportunities for public participation and ensuring that land-use matters are considered through an open and transparent process.

The County also appreciates the work of Planning staff, the Planning Commission, and the Board of Supervisors throughout the review of the applications.
